NON-DISCRIMINATION STATEMENT

In accordance with Federal civil rights law and U.S. Department of Agriculture (USDA) civil rights regulations and policies, the USDA, its Agencies, offices, and employees, and institutions participating in or administering USDA programs are prohibited from discriminating based on race, color, national origin, sex, disability, age, or reprisal or retaliation for prior civil rights activity in any program or activity conducted or funded by USDA.

Persons with disabilities who require alternative means of communication for program information (e.g. Braille, large print, audiotape, American Sign Language, etc.), should contact the Agency (State or local) where they applied for benefits. SECTION 504 OF THE REHABILITATION ACT OF 1973
Dell Rapids School District 49-3

Section 504 is an Act which prohibits discrimination against individuals with disabilities in any program receiving federal financial assistance. The Act defines a person with a disability as anyone who:

 

(1)  has a mental or physical impairment which substantially limits one or more major life activities (major life activities include activities such as caring for one’s self, performing manual tasks, walking, seeing, hearing, speaking, breathing, learning, and working);

(2)  has a record of such impairment; or

(3)  is regarded as having such impairment.

In order to fulfill obligations under Section 504, the Dell Rapids School District has the responsibility to avoid discrimination in policies and practices regarding its personnel and students. No discrimination against any person with a disability should knowingly be permitted in any of the program and practices of the school system.

The school district has responsibilities under Section 504, which include the obligation to identify, evaluate, and if the student is determined to be eligible under Section 504, to provide appropriate educational services. If the parent or guardian disagrees with the determination made by the professional staff of the school district, he/she has a right to a hearing with an impartial hearing officer.

The Family Educational Rights and Privacy Act (FERPA) also specify rights related to educational records. This Act gives the parent or guardian the right to: 1) inspect and review his/her child’s educational records; 2) make copies of these records; 3) receive a list of all individuals having access to those records; 4) ask for an explanation of any item in the records; 5) ask for an amendment of any report on the grounds that it is inaccurate, misleading, or violates the child’s rights; and 6) a hearing on the issue if the school refuses to make the amendment.

TITLE IX

 Title IX requirements and training. New Title IX Federal Regulations have been in place since Aug. 14, 2020. The regulations require that a school district’s Title IX coordinator receives training on how to serve impartially and without bias pursuant to § 106.45(b)(1)(iii). In addition, § 106.45(b)(10)(D) requires all training materials to be published on the Dell Rapids School District Website. Our Title IX Coordinator, Mr. John Silvernail, was trained through the State Bar of South Dakota, School Administrators of South Dakota (SASD), and Associated School Boards of South Dakota (ASBSD). Training materials for this training utilized resources from a number of sources including the U.S. DOE, NSBA/COSA, and other resources.

 Staff participated in Mandatory Title IX Compliance training. The training was provided by SafeSchools (Vector Solutions).

Melissa Larsen, Special Education Director of the Dell Rapids School District, in order to fulfill obligations of the Education for All Handicapped Children Act (EAHCA, P.L. 94-142) and the Individuals with Disabilities Education Act

(IDEA, P.L. 101-476) is required to inform and provide full educational opportunities to all individuals with disabilities ages birth through twenty-one.

The Dell Rapids School District has developed a system to identify, locate and evaluate individuals in need of special education or special education and related services. This Public Awareness Notice is to inform Parents and other interested individuals/agencies that individuals residing within the Jurisdictions of the Dell Rapids School District, ages birth through 21, are to be included regardless of the severity of their disability. This includes individuals in all public and private agencies and institutions within the legal boundaries of the Dell Rapids School District.

Anyone that is aware of a child who may benefit from special education and related services is encouraged to call or write the Dell Rapids School District Special Education Director.

The Birth to Three Service Coordinator, in conjunction with child identification process with the local school district, announces child identification awareness for children Birth through age two. These referrals should be directed to Melissa Larsen, at (605) 428-5473 or Fax (605) 428-5609. The purpose of the child identification process is to identify children, birth through age two, which may need services due to a disability or developmental delay.

Notification of Right Under FERPA

The Family Educational Rights and Privacy Act (FERPA) affords parents and students over 18 years of age (“eligible students”) certain rights with respect to the student’s education records.  These rights are:

1)     The right to inspect and review the student’s education records within 45 days of the day the Dell Rapids School District receives a request for access.

Parents or eligible students should submit to the building principal a written request that identifies the record(s) they wish to inspect.  The building principal will make arrangements for access and notify the parent or eligible student of the time and place where the records may be inspected.

2)     The right to request the amendment of the student’s education records that the parent or eligible student believes are inaccurate, misleading, or otherwise in violation of the student’s privacy rights under FERPA.

Parents or eligible students who wish to ask the Dell Rapids School District to amend a record should write the building principal, clearly identity the part of the record they want changed, and specify why it should be changed.  If the building principal decides not to amend the record as requested by the parent or eligible student, the building principal will notify the parent or eligible student of the decision and advise them of their right to a hearing regarding the request for amendment.  Additional information regarding the hearing procedures will be provided to the parent or eligible student when notified of the right to a hearing.

3)     The right to consent to disclosures of personally identifiable information contained in the student’s education records, except to the extent that FERPA authorizes disclosure without consent.

One exception, which permits disclosure without consent, is disclosure to school officials with legitimate educational interests.  A school official is a person employed by the Dell Rapids School District as an administrator, supervisor, instructor, or support staff member (including health or medical staff and law enforcement unit personnel); a person serving on the Dell Rapids School Board; a person or company with whom the Dell Rapids School District has contracted as its agent to provide a service instead of using its own employees or officials (such as an attorney, auditor, medical consultant, or therapist); or a parent or student serving on an official committee, such as a disciplinary or grievance committee, or assisting another school official in performing his or her tasks.

A school official has a legitimate educational interest if the official needs to review an education record in order to fulfill his or her professional responsibility. 

Upon request, the Dell Rapids School District discloses education records without consent to officials of another school district in which a student seeks or intends to enroll.  [NOTE: FERPA requires a school district to make a reasonable attempt to notify the parent or student of the records request unless it states in its annual notification that it intends to forward records on request.

4)     The right to file a complaint with the U.S. Department of Education concerning alleged failures by the Dell Rapids School District to comply with the requirements of FERPA.  The name and address of the Office that administers FERPA are:

Notification for Directory Information

The Family Educational Rights and Privacy Act (FERPA), a federal law, requires that the Dell Rapids School District, with certain exceptions, obtain your written consent prior to the disclosure of personally identifiable information from your child’s education records.  However, the Dell Rapids School District may disclose appropriately designated “directory information” without written consent, unless you have advised the District to the contrary in accordance with District procedures.  The primary purpose of directory information is to allow the Dell Rapids School District to include this type of information from your child’s education records in certain school publications.  Examples include:

·       A playbill, showing your student’s role in a drama production;
·       The annual yearbook;
·       Honor roll or other recognition lists;
·       Graduation programs; and
·       Sports activity sheets, such as for wrestling, showing weight and height of team members.

Directory information, which is information that is generally not considered harmful or an invasion of privacy if released, can also be disclosed to outside organizations without a parent’s prior written consent.  Outside organizations include, but are not limited to, companies that manufacture class rings or publish yearbooks.  In addition, two federal laws require local education agencies (LEAs) receiving assistance under the Elementary and Secondary Education Act of 1965 (ESEA) to provide military recruiters, upon request, with three directory information categories – names, addresses and telephone listings – unless parents have advised the LEA that they do not want their student’s information disclosed without their prior written consent.

If you do not want the Dell Rapids School District to disclose directory information from your child’s education records without your prior written consent, you must notify the building principal in writing by September 1st of each year.  The Dell Rapids School District has designated the following information as directory information:  [Note: an LEA may, but does not have to, include all the information listed below.]
